No Attorney For Former Tahoe Children’s Ski Instructor Facing Child Porn Charges ” CBS Sacramento

RENO, Nev. (AP) — A U.S. magistrate purchased a former children’s ski instructor in a Lake Tahoe resort held without bail indefinitely on Tuesday dispersing his federal trial on child pornography charges.

Judge William Cobb refused to set any bail conditions for the northern Nevada guy accused of photographing children as young as 3 in a toilet in a daycare centre that is rural through a hearing in federal court in Reno his mother manages within a church.

Cobb said he feared Stephan DeGraffenreid of Gardnerville might try to flee in the face of a possible life prison sentence, or even much more. However, the judge said he was more concerned.

DeGraffenreid, who had been fired from his job as an assistant in the Heavenly Ski Resort’s ski school, pleaded not guilty on April 6 to one count of sexual exploitation of a minor and two counts of attempted exploitation in addition to a single count of possessing child porn.

A conviction on one count takes a 15-year minimal, with a maximum of 120 years combined on all four counts, Assistant U.S. Attorney Shannon Bryant said Tuesday.

“By his own admission, (he) can’t control his child pornography addiction and fascination with children,” Bryant explained. He explained that through interviews with detectives, DeGraffenreid “equated his behaviour to having a ‘demon within me.'”

DeGraffenreid also reportedly told detectives it was easier to withstand urges to fantasize about pupils in the ski school since they “wear heavy clothes so he’s unable to see their own bodies,” Bryant told the estimate. “That should tell you there is an extreme threat to the neighborhood.”

Defense lawyer David Houston explained that against prosecutors’ claims, DeGraffenreid isn’t a pedophile or a predator. He shot the photos from a distance outside a open toilet door and never touched any of the children, Houston stated.

“This isn’t a situation where (the) defendant was luring anybody into a particular position so as to be photographed,” he explained.

Though DeGraffenreid “may possess recurrent sexual fantasies and recommends involving prepubescent females, his alleged crimes are non-contact sexual crimes,” Houston wrote in a formal request for bail. He desired him put with counseling and a GPS ankle bracelet on house arrest until the June 13 trial.

Houston told the judge he knows the “visceral reaction” to such behaviour and in no way would attempt to warrant it. However he explained DeGraffenreid has cooperated with authorities, and been “open and forthright … implicating himself and putting forth his involvement.”

A psychological risk assessment conducted by Dr. Earl Nielsen found DeGraffenreid to be “a low to moderate risk for future sex offenses and a very low danger of rectal or violent sex offenses,” Houston explained.

“We may abandon him incarcerated in jail until the eventual end of the proceedings, or maybe help seek him help,” Houston explained.

DeGraffenreid was arrested March 30 to one count of sexual exploitation of a minor. A complaint claims his phone was filled with nude photos of females he downloaded from the world wide web.

Kevin Cooper, a spokesman for Heavenly Ski Resort, stated DeGraffenreid was fired following resort officials heard about the investigation but had “no reason to believe that the alleged action has any connection with Heavenly Ski Resort or its guests.”
